General Terms

By using NCLab (”Service”, ”We”), you (”User”, ”You”) are agreeing to be bound by the following terms and conditions (”Terms of Use”). By ”Content” we mean any and all textual and graphical data on the Service posted by its users or by NCLab.

IF YOU ARE ENTERING INTO THIS AGREEMENT ON BEHALF OF A COMPANY, ORGANIZATION, OR OTHER LEGAL ENTITY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND SUCH ENTITY, ITS AFFILIATES AND ALL USERS WHO ACCESS OUR SERVICES THROUGH YOUR ACCOUNT TO THESE TERMS AND CONDITIONS, IN WHICH CASE THE TERMS ”YOU” OR ”YOUR” SHALL REFER TO SUCH ENTITY, ITS AFFILIATES AND USERS ASSOCIATED WITH IT. IF YOU DO NOT HAVE SUCH AUTHORITY, OR IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, YOU MUST NOT ACCEPT THIS AGREEMENT AND MAY NOT USE THE SERVICE.

NCLab reserves the right to update and/or change the Terms of Use from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to these Terms of Use. Continued use of the Service after any such changes shall constitute your consent to such changes. You understand and agree that NCLab cannot be responsible for user-generated Content posted on the Service. You agree to use the Service at your own risk. You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright or trademark laws).

Creating a User Account

When creating a user account in NCLab, you must provide your legal full name, valid email address, and any other information requested in order to complete the signup process. Your account may only be used by yourself (one person only) – a single account shared by multiple people is not permitted. You are responsible for maintaining the security of your account and password. NCLab cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You are responsible for all Content posted and activity that occurs under your account. One person may not maintain more than one user account. Users must not create an account with a name similar to the administrator account or other account belonging to the service in order to mislead other users or attempts to defraud personal data.

User-Created Content Policy

NCLab claims no intellectual property rights over your own Content on the Service. NCLab does not pre-screen Content, but NCLab and its designees have the right (but not the obligation) in their sole discretion to refuse or remove any Content that is available via the Service. You shall defend NCLab against any claim, demand, suit or proceeding made or brought against NCLab by a third party alleging that Your Content, or Your use of the Service in violation of this Agreement, infringes or misappropriates the intellectual property rights of a third party or violates applicable law, and shall indemnify NCLab for any damages finally awarded against, and for reasonable attorneys fees incurred by, NCLab in connection with any such claim, demand, suit or proceeding; provided, that NCLab (A) promptly gives you written notice of the claim, demand, suit or proceeding, (B) gives you sole control of the defense and settlement of the claim, demand, suit or proceeding (provided that you may not settle any claim, demand, suit or proceeding unless the settlement unconditionally releases NCLab of all liability), (C) provides to you all reasonable assistance, at your expense.

NCLab’s Intellectual Property

The look and feel of the Service, as well as all course materials, are considered intellectual property of NCLab and they are protected by copyright laws. You may not duplicate, copy, share or reuse any part of NCLab’s courses including tutorials, exercises, practical tasks and quizzes as well as solutions to exercises, practical tasks, and quizzes. You may not duplicate, copy, share or reuse any portion of the HTML/CSS, Javascript, or visual design elements or concepts without express written permission from NCLab. NCLab will prosecute violators of its intellectual property rights to the full extent of the law.

Privacy

NCLab does not follow individual users or their projects. To ensure stability of service, we monitor your usage of cloud computing resources (disk space, CPU time, memory, bandwidth). We also collect anonymous information related to how often each NCLab application is used. No information about NCLab users or their projects is provided to third parties. See Privacy Policy for more details.

Use of Unauthorized Resources

NCLab defines unauthorized resources as a website, a PDF file, social media page, chat session, etc. that contains solutions to exercises, practical tasks, or quizzes to any NCLab courses. All NCLab’s course content is considered NCLab’s intellectual property and as such is protected by copyright laws. Additionally, NCLab’s course content is never released to the general public. Therefore, if solutions to exercises, practical tasks, or quizzes were fraudulently obtained, using such unauthorized resources constitutes cheating. Providers of such unauthorized resources are in violation of NCLab’s intellectual property rights and nondisclosure agreements. If you are ever unsure whether the resources you are using is authorized or unauthorized, please contact support@nclab.com with your question or inquiry.

Consequences for Students and Trainees Caught Using Unauthorized Resources

Despite a student’s or trainee’s knowledge of whether content is considered unauthorized, if a student or trainee uses unauthorized resources in order to solve exercises, practical tasks, and/or quizzes, the student or trainee will be banned from taking NCLab’s courses and training programs for at least 12 months. In addition, his or her course or training program progress will be invalidated. No fees will be refunded. As mentioned above, these actions will be taken even if the student or trainee did not have fraudulent intentions. If you think you have discovered a site or provider that appears to be selling or distributing unauthorized resources containing NCLab’s course content, please inform NCLab by sending an email to support@nclab.com.

Trademark

The name ”NCLab” is registered as Trademark No. 85420518 with the U.S. Patent and Trademarks Office (USPTO). Its unauthorized use is prohibited.

Image Policy

Images from NCLab’s front page as well as any screenshots from inside of NCLab, and any images generated by applications running in NCLab, are licensed by Creative Commons Attribution-ShareAlike 3.0. Non-commercial and commercial use is permitted, as long as the name ”NCLab” and the link https://nclab.com are both mentioned.

Link Policy

Guidelines for how to link to NCLab:

  • NCLab cautions with regard to which websites are linked to nclab.com. This is because the NCLab could be associated – via the links – with the content of the website where the link is placed.

If you use links to access the NCLab website you are requested to observe the following points:

  • Do not use the NCLab logotype as a link to their website. This is intended to rule out any ambiguity as to who is responsible for the information on the website where the link is placed.
  • Do not use frame linking, i.e. do not link so that the NCLab is placed within the frameset of another website.
  • Do not use NCLab linking, i.e. do not link so that information is automatically downloaded from the NCLab website and placed on another website.

Receiving Occasional Promotional Emails from NCLab

By accepting these Terms of Use, you agree to receive occasional emails from NCLab with new features, webinar announcements, policy updates, and related information.

Other Conditions

Your use of the Service is at your sole risk. You understand that NCLab uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.

Technical support is only provided via email in English.

You must not modify or adapt the Service or modify another website so as to falsely imply that it is associated with the Service, NCLab, or any other Providers service. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by NCLab.

We may, but have no obligation to, remove user Content and accounts containing user Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Use.

Verbal, physical, written or other abuse (including threats of abuse or retribution) of any NCLab customer, employee, member, or officer will result in immediate account termination.

You understand that the technical processing and transmission of the Service, including your Content, may be transferred unencrypted and involve (1) transmissions over various networks, (2) changes to conform and adapt to technical requirements of connecting networks or devices.

You must not upload, post, host, or transmit unsolicited email, SMSs, or spam messages.

You must not transmit any worms or viruses or any code of a destructive nature.

If your bandwidth usage significantly exceeds the average bandwidth usage (as determined solely by NCLab) of other NCLab customers, we reserve the right to immediately disable your account or throttle your file hosting until you can reduce your bandwidth consumption.

NCLab does not warrant that (1) the service will meet your specific requirements, (2) the service will be uninterrupted, timely, secure, or error-free, (3) the results that may be obtained from the use of the service will be accurate or reliable, (4) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, (5) any errors in the Service will be corrected.

You expressly understand and agree that NCLab shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if NCLab has been advised of the possibility of such damages), resulting from (1) the use or the inability to use the service, (2) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service, (3) unauthorized access to or alteration of your transmissions or data, (4) statements or conduct of any third party on the service, (5) or any other matter relating to the service.

The failure of NCLab to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision. The Terms of Use constitutes the entire agreement between you and NCLab and govern your use of the Service, superseding any prior agreements between you and NCLab (including, but not limited to, any prior versions of the Terms of Use). You agree that these Terms of Use and your use of the Service are governed under Nevada law.

Account Suspension

NCLab reserves the right to suspend any user account which is in violation, or is suspected to be in violation, of these Terms of Use.
